Welcome to Momentum. These Terms of Service ("Terms") govern your use of the Momentum platform, website, and mobile application (collectively, the "Platform") operated by Momentum 231 LLC ("Momentum," "we," "our," or "us").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

5. Intellectual Property

All content, features, and functionality of the Platform — including text, graphics, logos, and software — are owned by Momentum 231 LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6. User Content

You retain ownership of content you submit to the Platform. By submitting content, you grant Momentum a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide the Platform services.

You represent that you have the right to submit any content you provide and that it does not violate any third-party rights.

7. Third-Party Services

The Platform may integrate with third-party services (e.g., Apple HealthKit, payment providers). Your use of third-party services is subject to their respective terms and privacy policies. Momentum is not responsible for third-party services.

8. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOMENTUM 231 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

11. Indemnification

You agree to indemnify and hold harmless Momentum 231 LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted at momentum231.com/terms. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
